BANKS BROTHERS TERMS AND CONDITIONS

  1. Ordering

1.1 We will not sell or deliver alcohol to anyone who is, or appears to be, under the age of 18. By placing an order, you confirm that you are at least 18 years old and we reserve the right not to deliver if we are unsure of this.

1.2 In the event that a product is unavailable when you place your order, we shall contact you to arrange replacement, or another arrangement for the completion of your order.

1.3 The placing of an order anywhere on our website will constitute a contract, which is made when we accept your order and process payment.

1.4 We reserve the right not to accept any order.

1.5 All goods are offered subject to availability.

1.6 We only sell to the UK. Our website is solely for the promotion of our products in the UK. Unfortunately, we do not deliver to addresses outside the UK.

  1. Delivery

2.1 For orders of all items the delivery window will be confirmed during the checkout process. We will do everything we can to meet this timeframe however we accept no liability for goods which fail to arrive within this window due to circumstances which we consider to be beyond our control.

2.2 If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may end the contract and receive a refund for any products you have paid for but not received.
2.3 Delivery costs. The costs of delivery will be as displayed to you on our website.
2.4 We cannot offer in-person collection.

3.1 All prices listed on this site are inclusive of UK VAT.

3.2 Although we endeavour to ensure that all pricing information on this website is accurate, occasionally an error may occur & goods may be mis-priced. If we discover a pricing error we will, at our discretion, either: contact you & ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

3.3 We reserve the right to adjust prices, offers, goods and specifications of goods at our discretion at any time before we accept your order. Where an end date is specified on any offer on the website, it is intended as a guide only. Banks Brothers reserves the right to change prices at any time.

    4.1 Products may vary slightly from their pictures. The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.
    4.2 Product packaging may vary. The packaging of the product may vary from that shown in images on our website.
  2. Returns

5.1 Customers have the right to withdraw from a contract entered into with Banks Brothers within 14 days following the day on which the Goods come into their physical possession without giving any reason. To exercise the right of withdrawal, a Customer must give written notice to Bank Brothers by emailing us at info@banksbrothers.co.uk
5.2 To be eligible for a return, your item must be unused and in the same condition that you received it.

5.3 To return your product, you should mail your product to: Banks Brothers, Oldstead Grange, Oldstead, York YO61 4BJ, United Kingdom
5.4 You will be responsible for paying for your own shipping costs for returning your item. If you are shipping an item over £20, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

5.5 Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit/debit card or original method of payment, within 10 days.

7.1 Users of this website may post reviews, comments and other content. This right is extended on condition that the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable. Specifically, content should not include software viruses, political campaigning, commercial solicitation, chain letters or mass mailings.

7.2 You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any content.

7.3 We reserve the right, but not the obligation, to remove or edit any content.

Grant Banks Brothers & its affiliated companies a non-exclusive, royalty-free & fully sub-licensable right to use, reproduce, publish, modify, adapt, translate, distribute, create derivative works from & display such content throughout the world in any media.

Grant Banks Brothers & its affiliates & sub-licensees the right to use the name that you submit in connection with such content, if they choose.

Agree that the rights you grant above are irrevocable during the period of protection of your intellectual property rights associated with such content & material. You agree to waive your right to be identified as the author of such content & your right to object to derogatory treatment of such content.

You represent & warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to Banks Brothers, the content & material is accurate; use of the content and material you supply does not breach any Banks Brothers policies or guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify Banks Brothers & its affiliates for all claims brought by a third party against Banks Brothers or its affiliates arising out of or in connection with a breach of any of these warranties.
